As used herein, "Owner" refers to Camera Lens Rentals LLC. "Customer" refers to you.
To enforce Owner's Ownership of the property and to protect Owner's right under this contract, Customer agrees Owner may re-take the property at any time and for such purpose. Owner or its representative may enter upon the premises of Customer who hereby waives any right of action against Owner for such retaking or entry.
It is understood and agreed that this personal property (sometimes herein called "equipment"), is leased to Customer by said Owner and will be used by the Customer for the stated period and only for the purposes for which this equipment was manufactured and intended. Use for any illegal purpose or in any illegal manner is prohibited.
It is further understood and agreed that Customer is familiar with this equipment and knowledgeable as to its proper use.
It is acknowledged that said equipment was personally inspected and examined by Customer and found to be in first class condition when received.
It is understood and agreed that Customer shall indemnify and save harmless Owner from or against any and all claims, demands and liability whatsoever including, but without limitation, all loss, costs, attorney's fee or damages on account of any injury to persons or property, resulting from the use of this equipment, and further, that the said property will be used solely by the Customer and/or persons herein designated and by no other person without the consent of the Owner.
It is agreed that Customer will immediately discontinue the use of any of said equipment should same, at any time, become in a state of disrepair and that Customer will immediately notify Owner of said facts: and in such event Owner agrees that it will with reasonable dispatch after receiving said notice, replace said equipment with other equipment in good working condition, if available. Owner is not responsible for any incidental or consequential damages caused by delays or otherwise.
The Customer agrees that on the date "return date", will immediately return the rented equipment and all attachments and parts belonging thereto to the office of the Owner in the same condition the same was received, ordinary wear and depreciation excepted, and Customer agrees to pay for any loss or damage said equipment occasioned during the lease period, as additional rental.
It is agreed that In the event the customer cancels the rental after it has been shipped, the customer will be billed the minumum rental fees and shipping fees. The customer will be billed a minimum one day rental, outgoing and return shipping fees.
It is agreed that In the event of a late return, Customer agrees to allow Owner to charge Customer's credit card for the appropriate late fee. The charge for late fees is 1/4 of the weekly rate per day with a minimum of $20 per day. An order is considered late if the equipment is not returned on the due date and Customer and Owner have not agreed to an extension of the rental period. If the charges are denied by the Customer's credit card, and the Customer has not contacted Owner regarding the late fee, the Customer understands that Customer's account will be turned over to a collections agency.
It is agreed that In the event of damage of any kind to the equipment, Customer agrees to allow Owner to charge Customer's credit card for the full cost of repair of said damaged equipment. Owner expressly reserves the right to choose the repair method and venue, within reasonable market value terms. Customer and Owner agree to be bound, legally and otherwise, by the report of Owner's chosen repair venue as to the cause of the damage to the equipment. If the charges are denied by the Customer's credit card, and the Customer has not contacted Owner regarding the repair cost, the Customer understands that Customer's account will be turned over to a collections agency.
It is agreed that In the event of loss or damage to any of the equipment by theft, mysterious disappearance, vandalism or malicious mischief, Customer shall immediately notify the police authority and Owner thereof. Customer agrees to allow Owner to charge Customer's credit card for the full retail price of a comparable substitute of equipment. The full retail price of a comparable substitute will be charged. If the charges are denied by the Customer's credit card, and the Customer has not contacted Owner regarding the overdue rental, the Customer understands that Customer's account will be turned over to a collections agency.
In any event, Customer agrees that the terms of this lease will continue and Customer shall be obligated to pay rent at the rate stated upon the face hereof until the equipment is returned to the Owner. In the event the Customer desires to extend this lease beyond the date originally agreed upon, Customer shall immediately notify the Owner of that intention and request approval and terms for such extension.
